| 内容記述 | This paper explains current issues of adult guardianship system and also deals with constitutional issues concerning human rights of advanced age. Adult guardianship system has been often discussed so far along the lines of the rights in the private law as elements of the Civil Code system. However, it has become evident that the contents of adult guardian system is also related to welfare laws in social welfare and medical care etc. Moreover, in case of rights of persons with disabilities we must take impacts of global treaties contracted into consideration. For these reasons I think it necessary and important that adult guardianship system should be dealt in accordance with constitutional rights and that problems of the system should be clarified in the relationships to public power, not to mention to private citizens relationships. | |||||||||||
